This policy sets out what personal data we handle when you shop with Emma & Blake New York, why we need it, and what you can ask us to do with it.

What We Collect

We only ask for the data we need to sell you clothing and get it to your door. Depending on how you use the site, that can include:

  • Your name and delivery address, so a parcel can be addressed and handed to a carrier.
  • Your email address, so we can send order confirmations, tracking details and replies about a return.
  • Your phone number, where you give it, so a carrier or we can reach you about a delivery.
  • Your order details: the dresses, knitwear, blouses or outerwear you bought, sizes, and the value of the order.
  • Payment information, which is entered and processed by our payment provider. Card details are never stored on our own servers.
  • Correspondence you send us, such as a return request, an order number or a photo of a faulty item.
  • Basic technical data from your visit, such as the pages you view, which keeps the site working and secure.

Why We Use It

Each piece of data has a purpose tied to your order or to running the shop:

  • To take payment and confirm that it succeeded.
  • To pack, ship and track your order, and to email you a tracking number when it leaves us.
  • To handle returns, replacements and refunds, including checking that an item meets our return conditions.
  • To raise a claim with the carrier if a parcel arrives damaged or goes missing, and to keep you updated.
  • To answer questions about sizing, fabric, fit or the status of an order.
  • To keep records we are required to keep for tax and accounting purposes.

We do not sell your personal data.

Who We Share It With

We share your data only with the parties that need it to complete your order:

  • Our payment provider. A certified provider processes the transaction over an encrypted SSL connection. Your card details go to them, not to us.
  • The carrier. Your name, delivery address and, where given, your phone number are passed to the carrier so the parcel can be delivered and tracked. The carrier also receives the information needed to investigate a claim for a damaged or missing parcel.
  • Service providers who run the site and our systems, such as hosting and email, acting on our instructions.
  • Authorities, where the law requires us to disclose information.

How Long We Keep It

We keep order and delivery records for as long as we need them to complete the order, deal with any return within the 30-day window, and meet the retention periods that tax and accounting law places on us. Emails you send us about an order are kept while the matter is open and for a reasonable period afterwards, in case you come back to us about it. When data is no longer needed for any of these purposes, we delete it or remove anything that identifies you.

Your Rights Under the GDPR

If the GDPR applies to you, you have the following rights over your personal data:

  • Access. You can ask what data we hold about you and receive a copy.
  • Rectification. You can ask us to correct data that is wrong or incomplete, such as a misspelled delivery address.
  • Erasure. You can ask us to delete your data, unless we still need it for an order or must keep it by law.
  • Restriction. You can ask us to pause our use of your data while a question about it is resolved.
  • Portability. You can ask for the data you gave us in a portable format, or ask us to send it to another provider.
  • Objection. You can object to our use of your data where we rely on a legitimate interest.
  • Withdrawing consent. Where you gave consent, you can withdraw it at any time. This does not affect what we did before you withdrew it.
  • Complaint. You can lodge a complaint with your local data protection authority.

Security

Payment pages are encrypted over SSL and the transaction is handled by a certified payment provider. We do not store card numbers on our own servers. We limit access to order data to the people who need it to fulfil orders and handle returns.

If our practices change, we will update this page. Please check it from time to time so you know how your data is handled.
